A member of the NTMA group on LinkedIn says the EPA has a pattern of overreaching its authority.
He quotes cases from EME Homer City, Florida Wildlife Federation, National Mining Association, Luminant Generation Co, the State of Texas, and Mingo Logan Coal Co, all of which had cases overturned by the Federal courts.
He also cites a dozen more recent regulatory cases overturned by the courts.
